Licensing

The Minister for Utilities is empowered to issue licences to allow an entity to either supply (retail supplier's licence) or distribute (distributor's licence) electricity in NSW. These licences are issued subject to conditions encompassing such matters as effective retail competition, consumer protection, greenhouse gas abatement, reliability and safety.

The Independent Pricing and Regulatory Tribunal administers the licensing regime on behalf of the Minister. It advises the Minister on licence issues with respect to:

• the granting, variation, transfer or cancellation of a licence
• the imposition, variation or cancellation of conditions in relation to a licence
• any action to be taken in respect of a contravention of the conditions of a licence
• any remedial action that may be warranted as a result of the contravention of the conditions of a licence
• the Tribunal may impose monetary and non-monetary penalties and take other action it considers appropriate against licensees for contraventions of licence conditions
