Regulatory Framework

Part 3 of the Water Industry Competition Act 2006 establishes the pathways for a party to seek access to an infrustructure services:

1. through coverage declaration which establishes a right for any party to negotiate terms and conditions of access with a service provider. If negotiations fail, coverage declaration gives an access seeker the right to apply to IPART for the dispute to be determined through arbitration, or

2. under terms and conditions set out in a voluntarity access undertaking approved by IPART.
