How is this draft policy different from the previous policy?
The updated draft policy is a refresh of the previous policy rather than a complete overhaul.
This is because:
- The compliance and enforcement principles, as set out in our policy, remain relevant and appropriate
- Our risk-based regulatory approach, as set out in our policy, continues to align with Government policy and contemporary regulatory practice
- Our enforcement approach, as set out in our policy, remains fit for purpose for IPART.
However, we have made improvements to the language, layout and general presentation of the policy to make it more contemporary and easier to read. We have also made a few more substantial changes, specifically:
- We've streamlined the 'risk assessment' content to keep core principles but present them more concisely and accessibly, with less jargon.
- A new section has been added on ‘public comment’. We have added this section to provide more guidance/structure on decisions to publish or make comment on compliance and enforcement action.
